. 1885 Sep 10 - An Immense Fortune. Prospective Millions, in which an Acton Family claims Legal Heirship.
Sometime ago we referred to the fact that Dr. Richard Johnston & family, residents of Acton & vicinity, were claimants of a large estate in England & that the Doctor was engaged in establishing his claims to a proportion of the estate. We are please to state that the prospects for the family coming into possession of their share of the property at no distant date are very encouraging., much more so in fact that in the majority of similar claims. The history of this estate - the celebrated Lawrence-Townley estate ...heirs of estates in England have for 40y. been making spasmodic efforts to get possession of the vast property, are now combining together to make a general investigation... enormous sum of $ 8 million ... by Act of British Parliament passed Aug 4, decided to pay over to all legal heirs their moneys.
In Toronto alone there are 20 families who have claims. One of the heirs will leave for England in a few weeks to compare notes with the London agent. Mr. Wm. Northcoate Geare, of 475 King St W is one of the heirs, is acting as agent, receiving correspondence. Mary Townely married John Lawrence in 1693 against the WILL of his parents, owing to religious differences. ... Millions of dollars have been spent in attempts to get possession of the estates.

JOHNSTON, Richard (d.), b. Toronto, 1815; d. in Esquesing in 1889, age 74. He was a son of Richard Lawrence Johnston, & was b. in Toronto when it was "Muddy Little York." He was a man of education & studied medicine with Dr. Ralph. Although not a regular practitioner, he performed a number of wonderful cures & seldom lost a case. He was skillful both as a physician & a nurse & was accurate in diagnosing. He was a sympathizer in the Rebellion of 1837-8 & was a Liberal in politics. At one time he owned considerable land in the heart of Toronto, owning the stores called "Checkered Stores."
In 1845 he set. in Waterdown, where he ran for M.P.P. He was a class leader in the Waterdown Methodist church & a Superintendent & teacher of the Sunday School. He has been twice married, first to Julia A. Teetzell, who d. age 34;
later he m. Mary Stevenson.
Issue: Robert J., (d.), Mrs. John Levins, Esquesing; Mrs. John McMaster, Washington State; Mrs. Austin Swackhammer, Daniel McKenzie, a Methodist minister in Minn.; Erastus, who owns a foundry in B.C.; Richard, William & Charles.

Robert J. was b. 1839 at Palermo. He purchased the west half of Lot 1, Con. 2, Erin, from the Canada Co., in 1865 & in 1874 bought the east half of Lot 2, Con. 2, which he cleared & erected buildings upon. He has raised a large family, who are representative citizens of to-day. In 1865 he m. Martha Leslie.

. History of the settlement of York - King & Toronto St., was was across from Robt. & Marg. Johnston's store.
The first owner of the lot was Thos Robert. Johnston, a carpenter, who held the property from the Toronto street lane to King St.
. 1834, opposite the Cathedral, on the southeast corner of Church & King, was a framed building known as the Checkered Store painted like a checker-board,
1st owner of the lot was Thos. & Robt. Johnston, a carpenter, who first held the property from Toronto St. ... lane to King St. ...In 1831 a man named R. A. Parker erected the Checkered Store, a 2 story frame building, selling notions, everything from a needle to an anchor. Ref: Globe Newspaper advertisement.
Note1: Opposite it to the eastward stood, the stood the gaol where Lout & Matthews suffered on the scaffold in the 1837 Rebellion.
Note2: This substantial brick building was later the Consumer's Gas Company. 2 historical plaques are on the front the the building. - PJA 2009.

This is the last WILL & Testament of me Robert Johnston of the City of Toronto, Carpenter. First pay my just funeral & testamentary + expenses. It is may will & desire that my beloved wife do receive & take the annual Rents & proceeds arising from my Real & personal Estate during her widowhood for the support of herself & the education support & maintenance of all my children. From & immediate after my said wife shall depart this life or they reach 21 years or marry, I devise & bequeath my Estate on King Street to my children as follows:
Son Richard: The lot & house on the corner of King & Toronto Streets in which Mr. Perrin now lives. [1834];
Daughter Mary Ann: The house & Lot adjoining the one devised to Richard;
Son Robert: The house & lot west of Mary' Ann's with the privilege to the secure belongings;
Son Thomas: The house & Lot west of Robert's with the privileges to the same belongings;
Daughters Margaret & Sarah: My Lot on Toronto St., north of the right of way, to the rear of the Lot before mentioned, to be equally divided between them, share & share alike;

To my 2 adopted children MARY & MARGARET.2 JOHNSTON, daughters of my brother Thomas [& therefore, also wife Margaret's sister's children - PJA]: The sum of £150 each on their arriving at age 21 or marriage. I desire that they may be supported in the same way as my own children out of my Estates.

Margaret Lawrence Johnston of Town of York, Appeared personally at the York General Quarter Session of the Peace today 1818 April 14. She is recognized to be a daughter of Richard Lawrence, formerly York Twp., now of Woodhouse, an UE Loyalist, who maintained his loyalty in the late war. Her husband is Robert Johnston of the Town of York, as her agent, he may locate in 200 acres. Husband Robert Johnston, Town of York, Carpenter, did his duty in defense of the Province during the late war.

. Checkered Store, In the spring of 1886 the building was torn down at the NW corner of King & Toronto streets to make room for the new Quebec Bank bluings. Opposite, to the eastward stood the jail.
. After the death of Robert Johnston & also of his wife Margaret Lawrence, Ezekiel Francis Whittemore was married to their daughter Margaret & had a marriage portion as devised to her by the WILL of her father, which as a portion of the property on Toronto Street. She never had any claim on the Checkered Store & lot on the corner of King & Toronto Streets. [i.e. beside their house].

. Mrs. Priscilla Belding Whittemore was similarly reinterred the next day on March 1876. Priscilla Whittemore's record reads, Removed to Mt. Pleasant Cemetery, Dec. 20th, 1906. It is noted further that all are recorded on the same page in the Necropolis Record Vol. 5 1875-1877.
Note2: *Sarah Kough, dau. of Thos. Johnston, is recorded together with the Johnston, although Mrs. Belding, Whittemore record's says four other family members were removed to Mt. Pleasant Cemetery.

. Toronto's Potter's Field, also known as the York General or Strangers Burial Ground was the first non-denominational cemetery in Toronto. Situated on the north west corner of of Yonge & 1 Bloor streets, in what today is the centre of Toronto known as Yorkville. It owes it's existence to Thomas Carfrae Jr., a wealthy retired merchant of Scottish ancestry. Mr. Carfae was appointed by a committee to purchase a burying ground, which he selected & bought the the 6 acres at Yonge & Bloor in May, 1826. The land was bought from Mrs. Elmsley for £75, which would be $300 in today's economy (2016).

. 1832 the great cholera outbreak killed many people in Toronto. During the outbreak the cemetery filled every quickly, especially during the summer of 1832. The cemetery's last interment took place on 21 January 1855, making 6,685 burials over 6 acres of land.
After the closure of the cemetery burials were moved Toronto Necropolis & Mt. Pleasant Cemetery.

. 1833 - UCLPetition 18, To Sir Peregrine Maitland, Lt. Gov. of UC, Petition of Charles Teetzel, Lawrence Hagar, Jacob Shouk, all Twp. Trafalgar & Jacob Markle, Twp. Toronto. We have been in this Province upwards of 20 years. During the late American war, the Petitioners served as militia men in 2nd Gore Reg. & done duty on the lines for 2 years & 6 months. Capt. Hepburn of their Regt. appointed to convey dispatches with zeal & fidelity for about 2 years & half, much to the satisfaction of their officers. That Petitioners having devoted so much of their time to the serviced of their King & County, were in consequence during that period, unable to provide for themselves & families. Charles Tetzeel having a wife & 5 children: L Hager, wife & 6 children, J Markle, wife & & 3 children. They therefore, pray for a grant of Land.

. Palermo Cemetery on Dundas Concession 1 SDS, Lot 30:
He sold the NE corner of his farm to be used for a cemetery & churchyard in 1818 to serve the community. He received £2 10 shillings as payment. The agreement said the land was "forever for the proper use of a place to bury the dead for them & as many of the inhabitants of Trafalgar Township lying between 12 & 16 mile Creeks as many think proper to join them & also for a meeting house & a School House should the same at any time be required." The cemetery plots were to be16 feet square & one of these lots were assigned to each family. For Charles Frederick Teetzel & his heirs there was to be a tract of land one square rod in size for a burial plot to be protected forever.

A log church was built on the front of the cemetery in 1812 to serve the Episcopal Methodist congregation of Laurence Hager. In 1851 a frame church was built beside the log church & it became the home of the Wesleyan Methodist Congregation. In 1867, a new modern church was built across the road for the Episcopal Methodists, but many still chose to worship at the old building. The log church was eventually used as a stable for some years. This was 17 years before the many Methodists united to become the United Church of Canada.

After his wife, Mary Tufford, died of consumption in 1856, Charles Frederick Teetzel stayed on his farm for 6 months. Ill health caused him to move to Milton for medical care. He died shortly after. His son, Mathias Hager, purchased land in St. Joseph's, Michigan & moved there about this time.

Charles married Mary TUFFORD on 29 Jul 1810 in Grimsby, Lincoln Co., Ontario. Mary was born on 4 Aug 1788 in Morris Co., New Jersey; died on 26 Mar 1856 in Palermo, Trafalgar Twp., Halton Co., Ontario; was buried in Palermo United Cemetery. [Group Sheet] [Family Chart]

. TUFFORD -
The Canadian branch of this family spell their name Tufford. The New Jersey family spell it Dufford & it has also been recorded as Du Ford * Tofort, which was its original spelling. Philip Tofort Sr. & Philip Jr. arrived at Philadelphia on the ship 'Robert and Oliver', 11 September, 1738. They settled in what was then called the Long Valley (German Valley), New Jersey. In his will dated 16 February, 1767, Philip Tofort, Sr., names his wife, Catherine, sons Adam & George, daughter Mary Magdalena & grandson George Stephen, son of Jacob Tofort. The NJ family history states that Jacob was disinherited because he married an Indian maiden.
George Tufford served in the War of 1812 with the 4th Lincoln Regiment.
