  1. 1.  James SMITH, UEL was born on 5 Aug 1758 (son of Capt. Austin SMITH, UEL and Mehitable TUTHILL); died in Aug 1822.

    Notes:

    F. K. Smith lists three children of Austin Smith and Mehitable Tuthill and James is not included. In the Moore Collection, however, there is a letter from Francis Smith of Wilmot NS, 30 Mar 1818 to his brother James Smith of Charlotteville, Upper Canada.

    James Smith named his grandson, James Moore, as the inheritor of his farm in Woodhouse Twp. at the south-west corner of Hwy # 24 and County Rd. 10, the Turkey Point Rd. It was clear that the Smiths didn't approve of their son-in-law, Enoch Moore, and passed over him in the will. The intersection where the farm stood became known as Moores Corners.

    James and Hanna Smith moved to Norfolk County, Upper Canada in 1815 after their daughter, Elizabeth, had moved there.

    The Moore archives contain an original certificate signed by prominent citizens of Annapolis County attesting to the Loyalist attribute of James Smith which he carried with him when he and his wife relocated to Upper Canada in 1815. The transcription follows>

    "To All Whom It May Concern:

    We the undersigned Inhabitants of Wilmot in the County of Annapolis Province of Nova Scotia do hereby certify that the Bearer hereof Mr. James Smith is a Loyalist who Emigrated into this province in the year One Thousand Seven Hundred and Eighty two from New York at the Cessation of Hostilities of the then Existing American War that he has ever supported an unimpeachable character and has been a useful settler and a good Member of Society, is now about to removed from this Country to Upper Canada to which place we are gratified in bearing testimony of his Loyalty and reputation during the span of thirty-three years, his stay in this Country.

    James married Hannah HAWKSWORTH in 1783. Hannah (daughter of Adam HAWKSWORTH and Elizabeth WEDGWOOD) was born on 6 Jul 1764; died on 17 Apr 1840 in Malahide Twp., Oxford County, London District, ON; was buried in Apr 1840 in Burdick Or Luton Cemetary, Malahide Twp..     1. Elizabeth SMITH was born on 18 Apr 1784 in Wilmot Township, NS; died on 3 Mar 1871 in Rockford, IL; was buried in New Milford Cemetery, Winnebago Co., IL.

  1. 2.  Capt. Austin SMITH, UEL (son of James SMITH and Jerusha TOPPING); died about 1788.

    Notes:

    Austin's son James was appointed adminsitrator of Austin's estate when the will was probated April 1789. The probate papers are on file in the Annapolis County Court House.

    Austin Smith and his brother Francis were among town officials in Orange County NY in 1775 and 1776.

    F. K. Smith writes, "At the beginning of the Revolution Austin Smith signed the Association Articles but appears to have changed his views and later he became a Loyalist (my capitalization). Not refraining from expressing their sympathies by both words and actions, he and others were for a time under arrest and the subjects of considerable attention from the Governor and other Officials. Later, he is found in Nova Scotia where at least two sons were with him in Annapolis County."
