That he has a family of a wife & 5 children & has never been in any other employment that farming.That he has taken the Oath of Alliance & did his duty in the Militia during the late War as appears by Certificate here to annexed. That he never before applied for any land from the Crown & being of ability & delirious to settle upon & improve a lot of 200 acres of the waste lands. Your petition humbly prays your Excellency will be please to grant him 200 Acres of land.

That your petitioner requested to be inserted & sworn in for his Majesty, enlisted by Thomas Betson, a Captain in his Majesty's Service in the then Colony of New York in the year 1777. That your petitioner came into this Province with his family in the year 1786 & has resided there ever since.
Wherefore your Petitioner prays that your Excellency may be pleased to order that his name be placed on the U.E. List & your Petitioner as in due bound will ever pray.

- Niagara District. Personally came before me John Hxx, Esquire one of his majesties Justice of the Peace of the Niagara District, Jacob Hoffman of the Berite Twp. in said district who being duly sworn deposth & saith that Henry Near of Bertie Twp. in said District, John Near of Humberstone Twp., in the said District & himself was enlisted & sworn in the year 1777 by Thomas Betson, a Captain in his Majestys Service in the then Colony of New York to serve his Majesty in the defense of this Colony against the Rebels. The deponent further says that the said Henry Near was appointed a Sergeant of the Company under the command Captain Betson, that in a short time after they had then enlisted as aforesaid the said Henry Near, by the order of Captain Betson ordered the deponent & John Near aforesaid & the rest of the Company to appear with them Henry Near, etc. at Tockoconick [Taughknaic &/ Tachkanick?] in the Colony of New York to meet the Enemy who was then advancing against Livingston Manor*

I leave to Certify that Henry Near, aged 71 years, [c1746] has resided nearly 30 years [1786] in the Township of Bertie & that John Near, aged 64 years [1753] & resided 18 years [1798] in Humberson Twp. & that they are both are honest labor & industrious inhabitants & that their sons were active & faithful in the discharge of their militia duty during the late war.

Council Chambers, 17 Nov 1804, MARY NEAR'S CASE
The petitioner's father having come into the Province within the time listed by the King's instructions & studying on the Council Books as a U.E., & it not appearing that there is any doubt, but that he is properly placed on the UE List. The Board does not concur in opinion with the Inspector General, that the Petition is not privileged.
The opinion of the Inspector General seems found on this idea, the as the petition, when she came in here, had been married many years & was the mother of a family & as her husband petitioned for & obtained family lands (in which was included 50 Acres on account of his wife in the usual way), therefore, she is not now entitled to received Lands as the Daughter of an UE. But the Board conceived that as the King's Instructions contained a general command to grant 200 acres to each of the children of a U. E. Loyalist, in cases where the parent came in with the limited time (viz.) July 1798 & as it is not suggest that any doubt arises on that hand, the Executive Government is not authorized to make any exception in cases where the fact is established that the applicant is the child of a U.E. & that her being 50 years of age can make no differences whatever.
If the Government thought proper to give her husband 50 acres on account of the petitioner, his wife, that must be considered as a further bounty from the Crown & this observation seems to carry with it the great weight, when it is considered that the Executive Government it is not authorized to grant the Lands of the wife to the husband & that nothing can be a compliant with the Royal Instruction, but the granting the inhabitance of the lands to the wife in her own name - it being, it is conceived, intended as a provision for the child of a U.E. & that child happens to be married, it is necessary to grant the land to the married women herself & not to put it in the powers of her husband by his own act to dispose her of it by a sale.

On the 2 May 1797 your petitioner was granted 100 Acres as family lands & on the same day his father, now deceased, on a petition signed & presented by your petitioner as his agent, was also granted a like quantity of family lands.
Your petitioner immediately afterwards voyaged the Order in the Surveyor General's Office & applied to locate Lot 18, Con 6, Burford under the said rules, that is to say, one half for his father & the other for himself & supposed the Lot was so located, but now finds that the same mistake disorder named only is on the Plan & as it for the whole Lot. He being desirous to receive a Patent for his own part of the Lot & to claim the other half under the land Commission, claiming under his father. He prays the Location may be amended on the Plan for half the Lot, as originally intended.
