    Omar Westell,resident of Kincardine for 51 years,was laid to rest in Kincardine cemetery on Thursday afternoon after service at the Linklater funeral home,conducted by the Rev. J L Ball of the Church of the Messiah,assisted by the Rev. L W Owen of St. John’s Church,Bervie . Pallbearer’s were friends and associates, W F Kearns,Charles Yaeger,Jack McGinnes,Graham Sproule,William Cobean and Jack Mitchell .Born in Clandeboye,Mr Westell came to Kincardine as the second to be foreman of the Grand Trunk Railway section out of Kincardine . He filled this post for 26 years retiring to serve as enginer at the salt company plant there . He later went to the Andrew Malcom Faurniture Company and was with it for 22 years retiring on the occasion of his eightieth birthday . Ill for 5 weeks he died on November 22 at the age of 84 . Surviving are 2 sons Earl of Detroit and Oran, of Kincardine and two daughters,Mrs. Frank Caesmore,Nelson B.C. and Mrs. William Tout,Kincardine. There are also 17 grand children and 14 great grand children .Relatives were Honorary pallbearers were Terry Tout,George Tout,Daryl Riggin,Wayne Schell,Junior Mctaggart,Bill Tout Jr. and Sean Tout.present from Port Hope,Peterborough,London,Stratford,Palmerston,Guelph and Toronto.

    Notes:

    While James died in Kincardine, he was buried in Clandeboye. This is according to the records of the Messiah anglican church in Kincardine which say he was buried in the” Clandeboye cemetery”. Ian Westell believes this was the Lewis Cemetery presumably beside his wife Jane. In 1963 all the tombstones were buried and a monument put up with all the names of those buried there. James' name does not appear however it is speculated that there was no tombstone as there was no money for one at the time of his death. -A copy of a 1932 report of the Cemetery Board contained in a London -middlesex Branch O.G.S. publication on cemeteries in middlesex county(No. 77 in Series) mentions that the number of internments was 50 yet the index in the publication only records 37 names so it is quite possible James could be buried there.

    James owned land in Clandeboye Biddulph Township on lot 12 Hodgins St. First Concession.Bought on December 1st 1869 and sold in 1904 as well as lots 5 and 8,range 4 bought in 1869 and sold in 1876 .See land transactions. An article in the London Advertiser of Tuesdy,April 13,1875 reported that this house of James Waistell burned down. 'Fire At Ireland Village-Some days since the dwelling house,cabinet shop and turning shop of Mr. Wm Howard of the village of Ireland were destroyed by fire... At the same time the houses of MR.Jas Westle and Mrs. Hawkesworth were destroyed...." In 1904 he moves to his sons home in Kincardine. In the newspaper Exeter Avocate on May 5,1904,page 1 it says he intends to sell his house to a Mr. Wilfins,butcher .

    Mr. and Mrs. Rich. Dagg Four Years past Diamond Anniversary
    Kincardine March 22- Just 64 years ago yesterday Mr. and Mrs.Richard Dagg of this town now 93 and 90 respectively were wedded in the town of Lucan.
    Though it is four years since the Diamond Anniversary of that wedding was celebrated ,the couple who have by two decades and more passed the prescribed three score and ten are sill activly iinterested in the world about them and appreciative of life and action.
    It was on March 21,1848 that Richard Dagg.a young Irishman had come to Canada while yet a youth,took as his bride Miss Elizabeth Culbert , of Lucan,the wedding ceremony having been solimized at that village. One of the pioneers of Biddulph township(middlesex) Mr. Dagg hewed his farm there from the virgin forest ,fighting with other pioneers of the trownship the battle of civilisation against the gigantic pines and maples of the forest. In the Fenian Raid of 66 he shouldered his rifle and marched to the front, for the protection of home and country..hard to read...he helped to build the original Broughs bridge at London. Proudly identified with the advancement of the Township of Biddulph and of Midlesex ,he is one of the better known men not only of the sesction of this part of , but of the entire Western Ontario peninsula. For the past few years Mr. and Mrs Dagg have been residents of the town of Kincardine ,and left their farm in Biddulph to reside here.
    Now,after a lifetime of noble usefulness in the pioneer upbuilding of his country ,he has a rich fund of stories and tales of pioneer happenings and incidents.Gifted with an excellent and unimpaired memory he delights in entertaining his grandchildren and great grandchildren with the stirring tales of pioneer days.
    Mr. Dagg is a staunch ..cant read...member of the anglican church and an old time conservative. He has been a life long reader of the London Press .
    The union,consumated over three score years ago ,has been blessed with five sons,four daughters,21 grandchildren,and 11 great grandchildren.
    The sons are James of Montana,Jon of Bervie,Henry,William, and Albert of Western Canada and Robert of Kincardine. The daughters are Mrs. Charles Hall ,Mrs.Omar Westell, and Mrs. Wardle , all of Kincardine,and Mrs. J. Smith Kilarney Man.
    Mrs. Robinson J. Orr of 262 Cheapside street ,London is a niece,while Mr. Thomas Culbert ,748 Wellington Street of that city ,is a brother of Mrs. Dagg--- London Free Press

    Land Transactions Mcgilivray Township

    The following is taken from the abstract of the deeds and mortgages registered in the record book showing the properties in Mcgilivray Township Middlesex county Ontario. They were viewed at the Ontario Archives.Toronto and at the Land Registry Office ,Court House,London Ontario.

    Lot 13, Concession 9 (approximately 100 acres) was bought by James Waistell Senior on June 1, 1855,and registered Jan 26,1859 from the Canada Company. James had previously leased the property. At the time of the purchase a mortgage was taken out from Timothy Buckley for $272. In July 14 1855 a Bill of Sale on title shows 50 acres, the North 1/2 being sold to Quinton McGill.In March 8, 1859, the south half was sold to John Morgan.

    Both Bill of Sales were registered March 31, 1859. The mortgage discharge between James and Timothy Buckley was not registered until October 22, 1864.

    Lot 14, Concession 9 was sold by the Canada Company to Isabella Morley (nee Waistell),consisting of 200 acres on Dec 7, 1867 (Registered January 9, 1868). There is a Bill of Sale on the property January 20, 1868 (Registered January 30, 1868) where Thomas & Isabella Morley sold to James Waistell Senior 100 acres. James then sold the south half (50 acres) to Pringle Waistell January 27, 1868 (Registered January 30, 1868). A mortgage was taken out April 18, 1868 from William Carter on the north 50 acres for $200. This mortgage was not discharged until July 26 1873 by Quinton McGill.

    The south half appears to be tied up in the estate of Pringle Waistell. The will was registered against the property October 8, 1868.

    On the north half, this is divided up according to James' will as mentioned above.

    The transfer is registered November 22, 1869. Richard transfers the deed of his 25 acres (the north half of the north half of the lot) to Quinton McGill February 7 1872. This was registered April 6, 1886 and after Quinton's death March 12, 1886. Quinton's will, which may have been dated July 30, 1885, was registered against the property (not clear as what parts but would have to be the north 50 acres) with the beneficiaries being Isabella M.Morgan (nee McGill) et al. A deed dated December 5, 1887 is registered showing the transfer of ownership of James Waistell et al to Isabella M and Mary J.Morgan (sisters) being the north 50 acres. This was registered February 13, 1888. There is another deed registered on title with the deed dated February 6, 1888 and registered February 13, 1888 with Isabella and Wm. Morgan transferring to Mary Jane Morgan so that Mary Jane ends up with the 50 acres making up the north half. On January 16, 1903 Mary Jane & Joshua Morgan take out a $525 mortgage from Joseph Hodgins.

    With the south half of 50 acres tied up by the Pringle's estate, there is a quick claim deed dated August 27, 1886 (registered September 20, 1886) transferring title from Sophia Hodgins( Pringle's daughter) to Robert & James Waistell.

    James Waistell Senior Born July 13,1794- Died November 12, 1868.

    In his will dated July 14, 1868, his wife, Isabella gets all personal and real estate and upon her death (she died I year later, September 26,1869), it was to be distributed among some of his children as follows:Robert P. Born 1815; died 1847. His wife Jane, married James junior,James son on December 2, 1858. Robert and Jane's daughter, Isabella would have been 22 at the time of her grandfather's death. She had married Thomas Morley the year before. (January 9,1867) She is not mentioned in the will. (see comments below concerning lot 14)Elizabeth, Born March 7, l817 was 5l at the time of her father's death. She was a co executor with her brother Richard. She got 25 acres being the south portion of lot 14,Concession 9 plus 1/2 the personal property after the legacies were paid.Mary Ann, born December 28, 1818 was 49. She had married Thomas Holley in Weston and received $100. James, (Junior) born August 25,1822 was 46. He received only $1. Speculation is that he was estranged from his father and was living in Lucan at the time. His first wife Bridget Ryan was catholic and the reason for the estrangement.

    Richard, born March 25,1825 was 43. He is named as an executor of the will.He received 25 acres being the northerly half of the North half of lot 14, Concession 9 plus 1/2 the personal property after the legacies were paid.Isabella, born May 6, 1827 was 41 at the time of her father's death. She had married George Miller Dec 15, 1855. She is not mentioned in the will.John was born June 22 1829 and died Feb 2, 1864. His children are mentioned in the will. Edward born Oct 12,1856 would have been 12 and John Parker, bornMay11 1862 received$40 each from their grandfather.

    Pringle, born November 22,l83l and died May 18, 1868 is not mentioned in the will.Thomas born April 5 1835 would have been 33 if he was still living, is also not mentioned in the will .
