3701 . Michael, Philip & Francis Kearny's property was confiscated in Monmouth County in the State of New Jersey, for joining the Army of the King of Great Britain, as returned to the Auditors Office, previous to the first day of May 1787. Signed, Arnold Dunham Auditor of Acct. NJ. 1 June, 1787.
NJ Case. 36374. Defendant Francis Kearney, State of NJ VS Francis Kearney, 1787.

. Francis Kearny was a captain in the corps of Col. Beverley Robinson in NY. In 1782 he was a major in Allen's Corps of Penn. Royalist. He rose to a lieutenancy-colonelcy & married in Ireland, whither he went after the war.

. FRANCIS KEARNY (Lieut.-Colonel)
He was born at Perth Amboy in New Jersey, circa 1752, & was in England from 1773 to 1777. Upon his return to America in March he joined the British forces &, on October 14 following, he was commissioned Captain in the Pennsylvania Loyalists, being promoted Major on November 15, 1780. Meanwhile, on May 9, 1778, he was appointed by General Sir William Howe a Deputy Judge Advocate at a court martial at Cooper's Ferry, New Jersey, the original commission of which is in W. O. 42 :Ki.
For four years he was on duty with his Regiment, the Pennsylvania Loyalists, in West Florida, under Major-General John Campbell, with much honor & reputation to himself, & was beloved by his General & highly esteemed by every officer. During the siege of Pensacola (from March 12 to May 8, 1781), he was in command of his Regiment, & according to his own narrative, the Spaniards had approached to within 500 yards of the British works, when a sortie was ordered & Kearny led the first division & at noon forced the enemy lines, routing them & destroying 7 pieces of ordnance. Afterwards he was in charge of the defense of the advanced redoubt, which, unfortunately, was blown up by a shell penetrating the magazine, killing & wounding 50 men, of whom he was one. In consequence, a capitulation immediately took place. With the papers of Major John Vandyke (q. v.) is a copy of the "Newport Mercury" for July 21, 1781, containing an account of the heroic siege of Pensacola, defended for 57 days by a small force against overwhelming odds. His narrative now proceeds to give an account of a part of Major Kearny's subsequent career. As an exile he made Ireland his residence & was again forming a comfortable establishment, when, in 1793, he was notified of his unsought-for appointment of a Corps then raising in Nova Scotia (the Royal Nova Scotia Regiment) & did not hesitate to give up a lucrative civil appointment. On his arrival in Nova Scotia he unexpectedly found that he had been appointed Lieutenant-Colonel. His letter laments his condition as one who had abandoned his home only to be retired on half-pay as Major, not, as he had expected, as Lieutenant-Colonel, & "conceives that the sacrifices he has made, his unimpeached loyalty & adherence to His Majesty, & His Government for those 46 years past give him some claim to a remuneration; had he employed that period" [during his absence in Nova Scotia] "in planting potatoes he might have been precluded the necessity of thus setting forth so mortifying a case." (W. O. 42 :Ki).

Francis Kearny was appointed Major of the Loyal Nova Scotia Regiment in 1793, & in 1801 he was Lieutenant-Colonel with Samuel Vetch Bayard. He was married on May 28, 1789, to Anne Herbert, spinster, in the Parish Church of Kinsale, Ireland, & died on March 26, 1828, at Armagh in Ireland, at the age of 76, leaving a widow & 6 children.
His son, James W. Kearney, is mentioned at Armagh in 1828. (W. O. 42:Ki).
Major Kearny was allowed £2,056 from his claim of £3,694. (A. O. 12 :ic»9). His property had been confiscated in Middlesex county, N. J., in 1778.
This Loyalist was the son of Philip Kearny, eminent counselor-at-law and noted Loyalist, who died at Perth Amboy,
New Jersey, July 25, 1775, and in his WILL of April 25, 1770, left property to his second wife, Isabella (daughter of Robert
Lettice Hooper, q. v.), and to his sons, Philip, Francis, Ravaud and Michael (q. v.). (A. O. 12:14, ff. 328-535; A. O. 12:100, f. 267; A. O. 13:109; Ind.: 5604-6; "Am. MSS. in Roy. Inst.," I :i39; Jones's "St. Peter's Church, Perth Amboy,"

[Summary] My Lord I have considered it my duty to omit the name of Justice Thorpe, Commission of Assiz, lately issued in the Province by the Executive Council have unanimously concurred with me in this measure. It should be dangerous to the peace of the Colony in regard to Mr Thrope, who appears to consider his character as a judge, but matter is to be chiefly ambitious character of a factious demagogue. …The address & answer are generally believed to be the production of Mr. Thorpe, no public meeting was ever held. Sheppard & Montgomery, the supposed chairman & Secretary, are ignorant Farmers, who can hardly write their names.

The Father of Reform in Upper Canada
Mr. Shepard was born in the colony of New Hampshire, New England, in 1767, nine years before the colonies unfurled the flag of independence & sought a name among the nations of the earth. His father & mother were natives of Ireland, & often have I heard him speak in the most indignant terms of the oppressors of the land of his forefathers, & of those wretched & (in many cases) infatuate beings called orange men, who are the mean instruments of that oppression.

Moses Wilson had a general store & kept a post office called Pine Orchard, over in the corner of the 6th Concession. Moses Wilson was sometimes odd in his ways, & at one time, when advertising his wares in the "Era" told the people he "was not Moses in the bullrushes; but Moses of Pine Orchard." He was a great talker, & his store served as a convenient rendezvous for the neighbours to assemble for local gossip, discuss politics, or express fee opinions respecting the doings of the municipal council.

Jerry Hunziker Feb. 20, 1937 - Jan. 30, 2015 NILES - Jerry Hunziker, 77, of Niles, passed away at Memorial Hospital in South Bend, Indiana on Friday, January 30, 2015 with his wife by his side. Jerry Hunziker was born in South Bend, Indiana on February 20, 1937, to Alexander & Dorothy Hunziker. Jerry was the middle child, sharing his childhood with his sister Mary & brother Jim. He was a graduate of Niles High School in Niles, Michigan. After high school, Jerry went to Michigan State University where he graduated in 1960 with a degree in Landscape Management & Horticulture.
As a young man just out of college, patriotism beckoned him. Jerry answered the call of duty as he entered the U. S. Army. Upon receiving his honorable discharge from the Army at the rank of Sargeant Jerry took a position in Delaware as a Landscape Designer.

With the decision to return to his hometown of Niles Jerry went in to the family business assisting in management of the sale department. In 1971, with great enthusiasm, he purchased the company from his father & Uncle Harold Hunziker. The company grew by expanding its market in to commercial opportunities, one of the largest being the US 20 bypass. Under Jerry's direction, the company received the National Award for landscaping the commons area of Whirlpool in Benton Harbor. This honor was given to Jerry by Nancy Reagan in the Rose Garden of the White house. Many schools in the surrounding areas as well as many streets in Michigan have the plantings of a Hunziker's crewman.

Jerry was a past member of the Niles Rotary, Michigan Association of Landscape Nurserymen, National Association of American Nurserymen & a lifetime member, for over 50 years, of the Elks Lodge Jerry developed the love of fishing at a very early age, volunteering to do the dirty work on the boats, just for a chance to get some fishing in & to learn from the older guys. He enjoyed his fishing buddies greatly. Along with many friends he fished many waters, including Lake Michigan, the Keys of Florida & the Hawaiian Islands.

Jerry is preceded in death by his parents, sister, Mary McCoy & Brother James "Jim" Hunziker.
He is survived by his wife, Pamela; her children Rea Vinall of Niles & Dave (Alexis) Wallace of Floyds Knobs, Indiana;
2 grandsons Julius & Jaden Vinall; brother-in-law, Craig McCoy of Dowagiac & many extended family & friends.

. McCUTCHEON, MR ERNEST, a native of Ospringe, struck was by a train, near Woodstock, & killed instantly, on Wednesday of last week. He had been gathering ferns along the right of way & did not see the oncoming train. He leaves a wife but no children.
Ref: Gazette, Boro, Manitoba.

. Very sudden & very sad indeed was the death of Ernest McCutcheon, late of 115 Oxford Street of Woodstock, Ont., who was struck by a G.T.P. freight train about 5 p.m. on Saturday, June 10th & instantly killed.
Mr. McCutcheon was an employee of the Canada Furniture Manufacturers Ltd., working in the shipping room & had the usual half-holiday on Saturday. Taking advantage of the fine weather, he went to the woods just west of the city to gather ferns &, having got a good supply, he was returning home when the accident occurred. It is supposed that he was crossing the tracks, almost where they cross, train coming from the west & he stepped out of its tracks, not seeing the train from the east which struck him. He was rather deaf & probably did not hear both trains. According to those at work near that point, the engine was whistling a warning before it got to him, but he walked on without noticing it. He was terribly mangled, having both arms & legs cut off, & his skull fractured. The inquest over the body was opened on Saturday evening at 8 p.m. when the jury empanelled viewed the remains & adjourned until Wednesday evening when evidence will be taken.
The death of Ernest McCutcheon has caused widespread sorrow in the city. He, with his newly married wife came here almost a year ago, & took up their residence on Oxford Street, where they bought their home. A man of sterling character & fine qualities Mr. McCutcheon soon became a prominent member of Chalmers Church at which he was a most regular attender & few members were as highly esteemed as he. The sympathy of the community goes out to Mrs. McCutcheon, who was terribly shocked when the news of the fatality was broken to her.
Deceased was this morning taken to his former home, Ospringe, where interment will be made. He is survived by his widow, his mother, Mrs. John McCutcheon of Ospringe; 6 brothers, Albert of Ospringe; John & Hiram of Manitoba; Mathias of Grimsby; William of Toronto & Austin of Everton, Ontario; also by 3 sisters, Margaret of Ospringe, Mrs. W. Currie of Michigan & Mrs. Lamont of Buller Street this city.

. Jennie was born in the large red brick house her father, John Walker, built next to his blacksmith & carriage shop at Scot & Main Streets, Erin, Ontario. She help to raise her younger siblings. Jennie & her new husband moved to Toronto where John Felker had a good job with CCM plant. On Thanksgiving & holidays they would go back to Erin to visit her mother & picnicking at Stanley Park in Erin or Belfountain.

Jennie had a hard time providing after her husband died young. Daughter Marie quit high school to help her mother & brothers. She sure loved her hockey & football. Jennie was famous for her apple & especially her mincemeat pies, which she made by hand in barrels for the fancy grocery store in Erin. Honestly, her peanut butter cookies were the best around! She made them with A & P Jack & Jill Peanut butter (Atlantic & Pacific Co.) She made some with chopped peanuts inside & there were made with a fork impression & a whole peanut on top.
The young Jennie Walker had worked in her grandparent's fancy grocery story in Erin. After she married John Felker, she had a grocery store beside her home at 324 Weston Rd., Toronto. They were the first to have large wooden cabinet radio in the store which stood in the middle of the entrance way. Neighbours would come in to listen to the programing.

. Jennie like to tell the story how one winter her father allowed Jenn to take his horse & cutter to go by herself, on the back roads to play the music at her girlfriend's wedding in the small white church, surrounded by trees. Well the country roads then often had cedar branches bushing you & the narrow washboard were certainly not planed flat like todays paved roads!
Jennie & sisters were always repeating that the snow in Erin used to be has high as the telephone poles.

Notes for further research:
Estimated years might be between 1899 to 1910 when Jenn was married in Erin Village herself. One might suppose the country church could have been a Disciples of Christ that Jenn attended in Erin Village but the Melville White Church, a mile & half (3 Kms.) south of Belfountain, today on the west side of 15962 Mississauga Road, south of The Grange Sideroad, would resemble the church. Gramma would point out the church when we passed it, but to be honest, it is difficult to reconcile the modern roads & settings. - PJ Ahlberg.-
