To Hon. Samuel Smith, Esq. In Council,
Petition of John Johnston of York, yeoman. Your petitioner is a son of the late Thomas Johnston of York, that he was born in North Britain & is 24 years of age. That he was resided permanently in this part of the Province [Kingston crossed out] age of 16 years last part. He has strictly conformed to al such military duty as was imposed on him since he became of age & has never applied for or received any land from the Government. Under such circumstances he humbly requests that your Honour in Council my be graciously pleased to grant unto him such a portion of waste land of the province, as in your wisdom may be deemed most subject to the present Regulations. . I certify John Johnston belong to my Company in the time of the late war & did take the Oath of Allegiance. Signed, Thos H Hamilton York, 3rd Reg. York Militia, 30 Jul 1817.
. 1834 Aug 12 his brother Robert, named him an executor, but he appears not to have taken the position as the widow & Alexander Hamilton & James Perrin, King Street shopkeepers acted themselves.

He wants his young children educated & supported until they are 18 or they have a profession of their own. He revokes the previous will in his hands.

Note: Elisha Pease married Catharine Cummer, & Margaret Lawrence-Johnston's cousin Peter Lawrence was married to to her sister, Elizabeth Cummer. - PJA.
