    Summary: John Combs, applied for Lot 16, Con 4, Saltfleet Twp. in Oct. 1830, L16, C4 had been set apart of the son of Charles Moore who should repaid the money paid to him. By reference to Minutes of Council 2 May, 1818, Chas. Moore received Lot 20, 3rd Concession. Viz. 15 & 16 in the same Con. 4 were reseted for the son of Chas. Moore. - Who the sold the Lots 15 & 16 to your petitioner John Combs. Lots 20 & 21 in the adjacent concession where THEN assigned to the the son of Charles Moore. Chas. Moore is unable to make compensation to me, John Combs & he is deprive of this Lot of land.

    We have lived in the neighborhood of Wm. Cowell who lives on Lot 15, Con 4, Saltfleet & John Corms the Farmer who lives Lot 16, C4, Saltfleet, 100 Acres each. "Wm. Cowell entered upon the lot entirely new & uncultivated state & he has lived there ever since & improved it to a considerable extent being as we now believe upwards of 20 years. Claims he entered upon the lot with other improvements than a small piece of ground chopped after the inner of clearing Land in the neighboroughood, leaving all the larger sized timber standing. He has lived on Lot 16 a number of years & now living on the Lot & when not on it himself, has had an other person on it & improving it for him in all about 17 years & had made considerable improvements. They are considered honest, moral & industrious men & have each of them large families. They posses with the exception of a small amount in chattels consists of the farms on said Lots of Land.
    Having the opportunity of being acquainted with both paired & licensed m? of the transaction between them, the purchase made by William Cowel & John Combs of the said Lots from Charles Moore, it is our decided opinion that William Cowell & John Combes ought to have the said Lots of Land granted to them. William Cowel has been sickly & in ill health for many years.'

I hereby certify that I have seen a Receipt a number of years past, given by Charles Moore, to John Combes, for a sum of money paid to him, Charles Moore for a Lot of Land but did not specify what Lot on the land lay, but it was understood to be a Lot in Saltfleet concerning which the parties are Contending. John Combes took procession of the Lot & made improvements thereon & has been in procession of it at all times since.
    I must in Justice to the present case observe that agreements were formerly made in too many instances in buying & selling land, without that attention to written instruments, any more that in the case of Chattle property & this is considered to be one of the many of the same kind.

    Petition of William Cowell, Saltfleet Twp., Yeoman.
    Your petitioner applied for Lot 15, Con 4, Saltlfleet, as the assignee of one Charles Moore, but your petitioner received the same answer that was given to John Combs. Your petitioner would now respectfully ask further considering the total inability of Charles Moore to make compensation for the breach of his agreement with your petitioner, terms upon which, his son was to receive a part of the above lot. In as much as he attempted to mislead the Honorable Council in that he had improved said lot, which in fact was unproved thereon, & he then sold & received full consideration for the same from your petitioner.
    That if your petitioner is deprived of said Lot, his family consisting of a wife & 7 children out of 12 depending upon him for support, will be reduced total hence independence. He therefore, prays your Excellency in Council will be pleased to grant him relief.

    To The Executive Council at City of Toronto:
    Where we the undersigned subscribers duly state Charles Moore of Saltfleet was empowered by the Attorney to act on behalf of his John Moore on one part & William Cowell Senior on the other part. Having carefully interrogated the different clams to Lot 15, Con 5, Saltfleet, Lot took up by parties in difference. We are of the opinion as a matter of justice that said Lot ought to belong to Wm. Cowell. Said Cowell paid Charles Moore for the said Lot. We respectfully recommend the Council do cause the Patent be made out in favor of William Cowell Senr. of Saltfleet.

They also heard said Moore persistently refuse to have said dispute to their discussion of an arbitrator, saying he thus said Moore had nothing to do with it.

    Petition of Wm. Cowell. He was aware Enoch Moore obtained a grants of certain Lots, inc. L15, C4; Charles Moore is the eldest son of Enoch Moore. In 1811 your petitioner purchased this lot from CM for £25. The Article of Sale inscribed by both parties, to be delivered as soon as CM obtained the Patent of Enoch Moore, then deceased. Your Petition commented his improvements, cleared upwards of 50A, built a house, barn & other offices.
    In 1817 CM. instead of fulfilling his engagements with your Petitioner, secretly & unknown obtained from the Administrator Lands grants from his late father were given to himself & his sister. The Council not being aware of these circumstance made an Order grannie him certain Lots & reserving others for the son of Chas. Moore. Refer to his Petition of 7.6.1832 requesting this Lot. He humbly prays an Order in Council may be reveres & that the Lot on which all his labour has been extended & his hime which he reared 12 children, may be confirmed.

Your petition resided 25 years in this Province served as a Volunteer in Captain Drumonds? Flank company, 2nd York Militia in the late war. Please take his case into consideration & grant him such relief.
